Robert also advises on leasehold matters and onerous ground rents in professional negligence claims, including providing Expert Witness Reports with detailed analysis of evidence, settlements and relevant cases. 

Robert acted as an expert witness in the leading onerous ground rent professional negligence claim, Arrassey Properties Limited v Nelson Solicitors.

HHJ Baucher in her Judgement stated ‘I consider there was a stark contrast between the two experts…. …..Mr Kaye was an impressive witness….. In keeping with the careful manner in which he prepared his reports and the joint statement, I found he presented his evidence in a similar manner. Mr F made no inroads in relation to that evidence during cross-examination. I found his evidence on all issues to be clear, logical and compelling. It was tendered in a measured fashion. I have no hesitation in accepting Mr Kaye’s evidence in its entirety.’

The case is also a reminder of the duties of an Expert Witness to the Court.
